Collection Actions
How Collection collects from consumers
Collection Actions by creditors, lenders, or debt collectors against consumers have exploded in recent years. There is not only an increase in the number of consumer debts being enforced in the courts, but also a number of such actions in which the consumers do not owe the debt or have substantial defenses, or in which the collector has no reliable evidence whether the consumer owes the debt or not.
Collectors may seek to collect on such debts by sending lengthy requests for admissions to the consumers that may then be admissible in court if the consumers fail to respond in a timely manner.
